【クラブホークスエポスカードお申し込みアプリについて】
１．クラブホークスエポスカードお申し込みアプリ（以下「本アプリ」といいます）は株式会社エポスカード（以下「当社」といいます）が発行する「クラブホークスエポスカード」のお申し込み（以下「本サービス」といいます）にご利用いただけるスマートフォン用アプリです。
２．本アプリは、当社所定のスマートフォン端末でのみご利用いただけます。
３．本アプリのダウンロード及び本サービスのご利用は、本アプリをダウンロードするスマートフォン等の端末所有者ご本人様に限らせていただきます。

【規約へのご同意】
１．本アプリのダウンロード及び利用にあたり、お客様は本規約に同意していただく必要があります。

【本アプリの権利帰属】
１．本アプリに係る一切の権利（著作権その他の知的財産を含む）は弊社または弊社の提携先に帰属します。

【免責事項】
１．当社の故意または重大な過失による場合を除き、当社は本アプリのダウンロード及び利用において生じた損害、並びに第三者からお客様に対してなされた損害賠償請求に基づく損害について、一切責任を負わないものとします。
２．お客様が本アプリをダウンロードしたスマートフォン等の端末、通信機器、本アプリの障害、回線の不通等、もしくは火災、停電、天災地変、戦争等の不可抗力により本アプリが利用不能となった場合、またその為に生じた損害（入会特典が提供されなかった場合を含む）について、当社は一切責任を負わないものとします。
３．本アプリは当社所定のスマートフォン端末であっても、スマートフォン端末の状態等によって正常に作動しない場合があります。本アプリが利用不能となった場合、またその為に生じた損害（入会特典が提供されなかった場合を含む）について、当社は一切責任を負わないものとします。
４．本アプリをダウンロードするスマートフォン等の端末所有者以外の方が本サービスを利用した場合、その為に生じた損害（本サービスの受付を当社が拒否した場合、入会特典が提供されなかった場合を含む）について、当社は一切責任を負わないものとします。

【本アプリの変更】
１．当社は、お客様に事前に予告することなく、適宜本アプリの内容を変更または修正することがあります。
２．お客様が本アプリをダウンロードした後、当社が本アプリを変更または修正した場合、本サービスを利用前に再度最新版の本アプリをダウンロードしていただく必要があります。

【本アプリのダウンロード・利用に際してのご注意】
１．本アプリでの本サービスの利用は、お客様１人につき１回限りとさせていただきます。
２．本アプリのダウンロード(再ダウンロードを含みます)及び本サービスの利用にあたり通信料がかかる場合がありますが、この場合の通信料は全てお客様のご負担となります。
３．お客様は、本アプリで本サービスを利用するにあたり、運転免許証を本アプリで撮影し、運転免許証の情報を本サービスのお申し込みに使用することができます。その場合、お客様は運転免許証の画像データを当社に提供し、当社は運転免許証の画像データから「氏名」「生年月日」「住所」「運転免許証番号」「有効期限」等を読み取り使用することを承諾するものとします。
４．運転免許証の画像データ及び読み取りした情報は、お申し込みが不成立となった場合を含め、いかなる場合でも返却及び消去は承れません。
５．本アプリでお客様が入力中の情報は、本アプリの操作により、当社が受信する前に消失する場合がありますが、当社は一切責任を負わないものとします。
６．本アプリによる本サービスを当社が受付し、当社が認めた場合、当社の提携先において本アプリの特典確認画面を提示することで会計時の割引等の入会特典を受けることができます。
７．提携先での入会特典は、当社がその付与を認めた場合でも、お客様のスマートフォン端末及び通信環境等により、特典確認画面をお客様のスマートフォン端末に表示できない場合は適用されません。またその場合において、当社は一切責任を負わないものとします。

【禁止事項】
１．当社は、本アプリに関して以下の行為を禁止します。
(1)本サービス目的以外の本アプリの使用。
(2)本アプリの一部のみのインストール及び使用。
(3)本アプリの改変。又はリバースエンジニアリング（主に、ソフトウェアの内容を解析して、人間が読み取り可能な形に変換することを指します）、逆コンパイル、逆アセンブルその他これらに類する行為。
(4)本アプリの全部又は一部の複製、翻案。
(5)本アプリの全部又は一部を、有償、無償を問わず、公衆送信、頒布、譲渡、貸与その他の利用をする行為。
(6) 対価を受ける目的で本アプリを自ら利用し、または第三者に利用させる行為。
(7)本アプリまたはその使用権を第三者に販売、賃貸、使用許諾する行為
(8)本サービスの運営を妨げ、その他本アプリの提供に支障をきたす恐れのある行為。
(9) 本規約等に違反する行為、その他弊社が不適当とみなした方法で本アプリを利用する行為。

【本サービスの中止・廃止】
１．当社はお客様に事前に通知することなく、本アプリのダウンロード及び本サービスを中止及び廃止することがあります。

【規約の準用】
１．本アプリの利用にあたり、本規約に定めのない事項については、当社の「カード規約」「個人情報の取り扱いに関する同意事項」等の他の規約・規定を準用します。

【規約の変更】
１．当社は、本規約の内容を変更する場合があります。本アプリのダウンロード後に変更した場合を含め、本サービスの利用時点での規約を適用するものとします。

※スマートフォン（AndroidOS）4.0以前のOSでは動作保障はいたしません。
※タブレット端末での動作保障は行っておりません。
