تعريف الإفتاء :

الإفتاء لغةً: أصل الفعل "فتي أو فتو"، والإفتاء مصدر "فتي" تعني "الإبانة، أي إبانة الشيء على حقيقته بالبيان والعلم، ويقال أفتيت فلان أي أجبته عن مسألته التي سأل عنها.

الفتوى إصطلاحاً: الفتوى هي جواب المفتي عن أي سؤال من السائل وكان متعلّقاً بالحكم الشرعي للسؤال، وتكون الإجابة "إجتهاد" من المفتي فيما يتعلّق بالسؤال، بالإستناد إلى الأحكام الواردة في القرآن الكريم والسنّة النبويّة الشريفة.

أركان الفتوى:

أركان الإفتاء أربعة؛ وهي: المفتي، والمستفتي، والمستفتى عنه، والمفتى به.

1- المفتي: وهو العالم الشرعي الإسلامي الذي يقوم بإصدار الفتوى والإجابة عن السؤال.

2- المستفتي: وهو الشخص الطّالب للإجابة والحكم الشرعيّ.

3- المستفتى عنه: وهو السؤال عن الحكم، والمسألة المسؤول عنه، ويجب أن تكون هذه المسألى فيها إلتباس وتحتاج بياناً في الحكم، ويجب أن يكون المستفتى عنه فيه لبس وليس حكماً شرعيّاً واضحاً.

4- المفتى به: وهو الحكم الشرعيّ والجواب عن السؤال، ويكون الجواب مستمدّاً من القرآن الكريم، أو السنّة النبويّة، أو بالإجماع.

1. Mufti: a legitimate Islamic world, which issues a fatwa and answer the question.

2. Poller: a student's person to answer the legitimate government.

3. Respondent with him: a question of judgment, and the issue responsible for it, and this must be where the confusion aqueductus and need a statement in the judgment, the respondent should have him wear it and not a legitimate judgment clear.

4. Mufti him: a legitimate governance and the answer to the question, and the answer is derived from the Koran, or the Sunnah, or unanimously.
