الأهداف العامة للمقرر:
المؤمل منك –عزيزي الدارس- أن تكون بعد استيعابك لمباحث هذا الكتاب قادرا على الآتي:
(1) توضح أقسام الأدلة الشرعية باعتباراتها المختلفة، من حيث الاتفاق والاختلاف، والأصلية والتبعية، والعقلية والنقلية، ومراتبها.
(2) تقارن بين الأدلة الشرعية المتفق عليها بين أئمة المسلمين، أي: التي لم يرد فيها خلاف يلتفت إليه، والأدلة الشرعية المتفق عليها بين جمهور المسلمين، أي: التي ورد فيها خلاف من بعض الطوائف، لكنه خلاف لا يعتد به.
(3) تستوعب الأدلة المختلف فيها بين أهل العلم، إذ لا تخلو من قائل بها، مع أهميتها في الاجتهاد عند عدم وجود الأدلة المتفق عليها، أو وجودها لكنها تفيد في تكثير الأدلة، الذي يحتاج المجتهد للترجيح بكثرة الأدلة عند التعارض وتعين ذلك.
(4) تستشعر عظمة اجتهادات الأئمة الأعلام، وصدورهم عن الدليل، وعدم الاستجابة للهوى والتشهي.
(5) تثق باستنباطات الأئمة، وتعرف مآخذهم وأدلتهم، ومدارك الأحكام عندهم.
(6) تدرك سعة الشريعة الغراء، وقدرتها على الوفاء بأحكام المستجدات، وتشرحه لغيرك.
تؤمن بصلاحية الشريعة لكل زمان ومكان وإنسان، وحيوان، وتسير على مقتضى ذلك. General objectives of the decision:
