القضاء الاداري

بعد دراستك لهذا المقرر ينبغي أن تكون قادراً على:
1- بيان ماهية وأهمية مبدأ المشروعية في النظام الإسلامي والوضعي، باعتباره المرتكز الأساسي لدولة القانون.
2- بيان أهمية الرقابة على أعمال الإدارة وأنواعها، مع التركيز على الرقابة القضائية واهميتها ودور القضاء الإداري المتخصص في تحقيق ذلك.
3- بيان نظم الرقابة القضائية على أعمال الإدارة العامة بداية بقضاء المظالم الإسلامي، ثم نظامي القضاء الموحد، والقضاء المزدوج.
4- تحديد ماهية دعوى الإلغاء، وبيان شروط قبولها، واجراءات رفعها، وكيفية الحكم فيها.
5- بيان ماهية دعوى التعويض، ومسئولية الدولة عن أعمال موظفيها، سواء تلك القائمة على أساس الخطأ، مع بيان كيفية التمييز بين الخطأ الشخصي والخطأ المرفقي، أم تلك التي تقوم بدون خطأ، ومعرفة كيف يكون التعويض الإداري وطبيعته.
6- بيان التنظيم القضائي الحالي للمحاكم في اليمن، وبيان المحاولات التشريعية الرامية لإنشاء قضاء إداري مستقل. ومن ثم دور القضاء اليمني ومدى ولايته على أعمال الإدارة . After studying this decision you should be able to:
1. Identification of the importance of the principle of legality in the Islamic system and positive, as the bedrock of the rule of law.
2. Statement on the importance of management control and types of work, with a focus on judicial control and the importance and the role of the Administrative Justice who specializes in achieving this.

5.
