Luật bảo hiểm xã hội sửa đổi có hiệu lực từ ngày 1/1/2016 điểm mới của Luật BHXH năm 2014 là với những trường hợp thai sản mà chỉ có cha tham gia BHXH, cũng được hưởng trợ cấp một lần khi sinh con.

Về chế độ hưu trí, để đạt được tỷ lệ hưởng lương hưu tối đa 75%, Luật BHXH năm 2014 đã quy định lộ trình tăng dần thời gian đóng BHXH, tiến tới NLĐ có thời gian đóng BHXH đủ 30 năm với nữ và 35 năm với nam, được hưởng lương hưu tối đa 75%. Với những trường hợp nghỉ hưu trước tuổi quy định, sẽ giảm trừ tỷ lệ hưởng lương hưu lên 2% (quy định hiện hành là 1%) cho mỗi năm nghỉ hưu trước tuổi. Theo lý giải của lãnh đạo Bộ LĐ-TB&XH, quy định này nhằm tránh tình trạng NLĐ muốn nghỉ sớm.

Đối với những trường hợp giải quyết BHXH một lần, Luật BHXH 2014 cũng quy định theo hướng thắt chặt, chỉ giải quyết với những NLĐ đã hết tuổi lao động mà không đủ điều kiện hưởng lương hưu hoặc ra nước ngoài định cư hợp pháp. Với những lao động còn tuổi lao động có thể chuyển sang hình thức tham gia BHXH tự nguyện đến khi đạt đủ số năm đóng BHXH để nhận lương hưu. Điều này thể hiện tính ưu việt và nhân văn của Luật BHXH mới bởi bảo đảm NLĐ khi về già sẽ có lương hưu để duy trì chất lượng cuộc sống.
