Hukum Dasar Asas Islam

Hukum-hukum islam yang merupakan syara' dalam Islam dalam berbagai bidang mengenai Asas-asas islam.
Terkait dengan susunan tertib syariat, al Qur'an dalam surat Al Ahzab ayat 36 mengajarkan bahwa sekiranya Allah dan Rasul-Nya sudah memutuskan suatu perkara, maka umat Islam tidak diperkenankan mengambil ketentuan lain. Oleh sebab itu, secara implisit dapat dipahami bahwa jika terdapat suatu perkara yang Allah dan rasul-Nya belum menetapkan ketentuannya, maka umat Islam dapat menentukan sendiri ketetapannya itu. Pemahaman makna ini didukung oleh ayat al Qur'an dalam Surat Al Maidah[2] yang menyatakan bahwa hal-hal yang tidak dijelaskan ketentuannya sudah dimaafkan Allah.

Dengan demikian, perkara yang dihadapi umat Islam dalam menjalani hidup beribadahnya kepada Allah itu dapat disederhanakan dalam dua kategori, yaitu apa yang disebut sebagai perkara yang termasuk dalam kategori Asas Syara' (ibadah Mahdhoh) dan perkara yang masuk dalam kategori Furu' Syara' (Ghoir Mahdhoh).

Asas Syara' (Mahdhoh)
Yaitu perkara yang sudah ada dan jelas ketentuannya dalam al Qur'an atau al Hadits. Kedudukannya sebagai Pokok Syari'at Islam di mana al Qur'an itu asas pertama Syara` dan al Hadits itu asas kedua syara'. Sifatnya, pada dasarnya mengikat umat Islam seluruh dunia di manapun berada, sejak kerasulan Nabi Muhammad hingga akhir zaman, kecuali dalam keadaan darurat.

Keadaan darurat dalam istilah agama Islam diartikan sebagai suatu keadaan yang memungkinkan umat Islam tidak mentaati Syariat Islam, ialah keadaan yang terpaksa atau dalam keadaan yang membahayakan diri secara lahir dan batin, dan keadaan tersebut tidak diduga sebelumnya atau tidak diinginkan sebelumnya, demikian pula dalam memanfaatkan keadaan tersebut tidak berlebihan. Jika keadaan darurat itu berakhir maka segera kembali kepada ketentuan syariat yang berlaku.

Furu' Syara' (Ghoir Mahdhoh)
Yaitu perkara yang tidak ada atau tidak jelas ketentuannya dalam al Quran dan al Hadist. Kedudukannya sebagai cabang Syariat Islam. Sifatnya pada dasarnya tidak mengikat seluruh umat Islam di dunia kecuali diterima Ulil Amri setempat menerima sebagai peraturan / perundangan yang berlaku dalam wilayah kekuasaannya. Perkara atau masalah yang masuk dalam furu' syara' ini juga disebut sebagai perkara ijtihadiyah.
Syariat Islamiyyah adalah hukum atau peraturan Islam yang mengatur seluruh sendi kehidupan umat Islam. Selain berisi hukum, aturan dan panduan peri kehidupan, syariat Islam juga berisi kunci penyelesaian seluruh masalah kehidupan manusia baik di dunia maupun di akhirat.

Related to the orderly arrangement of the Shari'a, the Qur'an in surah Al Ahzab verse 36 teaches that if only Allah and His Messenger have decided a matter, then Muslims are not allowed to take other provisions. Therefore, it is implicitly understood that if there is a case that Allah and His Prophet have not set terms, then Muslims can define their own permanence of it. Our understanding of what is supported by the verse of the Qur'an in Surah Al Maidah [2] which states that things are not explained its provisions are already forgiven God.

Thus, the case faced by Muslims to live a life of worship to God it can be simplified into two categories, namely what is called as the cases included in the category of principle Syara '(worship Mahdhoh) and cases that fall into the category of Furu' Syara '(Ghoir Mahdhoh).

Syara principle '(Mahdhoh)
That is the case of existing and clear provisions in the Qur'an or Hadith al. His position as Principal of Islamic Shari'ah in which the Koran was the first principle and al Hadith Syara` the second principle of Personality '. By its very nature, essentially tying Muslims around the world wherever they are, since the apostleship of the Prophet Muhammad until the end of time, except in emergencies.

Emergencies in terms of Islam is defined as a state that allows Muslims do not adhere to Islamic Law, is a state of forced or under circumstances that endanger themselves inwardly and outwardly, and the condition is not unforeseen or unwanted previously, as well as in utilizing state is not excessive. If the emergency was over it immediately returns to the provisions of applicable law.

Furu 'Syara' (Ghoir Mahdhoh)
That is the case that there is no or unclear provisions in the al-Quran and al-Hadith. Capacity as a branch of the Islamic Sharia. Basically non-binding nature of all Muslims in the world except Ulil Amri received the local receiving as rules / regulations that apply in the territory. Matter or issue included in furu 'Personality' is also referred to as ijtihadiyah case.
