Kuduri Hanefi Fıkıh Kitabı

* İslami kütüphanemizin bir diğer eseri olan Kuduri Hanefi Fıkhı adlı eser yer almaktadır.

* Hanefî mezhebi fıkıh âlimlerinin büyüklerinden. İsmi, Ahmed bin Muhammed el-Bağdâdî olup, künyesi Ebü’l-Hüseyn’dir. Kudûrî lakabı ile tanınır. Hangi şeye nisbetle kendisine Kudûrî denildiği kat’î olarak bilinmemekle beraber, Kudûr, Bağdad yakınlarında bir köyün adıdır. Bu zâtın da orada doğmuş olabileceği, oraya nisbetle Kudûrî denildiği tahmin edilmektedir. Ayrıca Kudûr, çömlek ma’nâsına gelen (Kıdr) kelimesinin cem’i olup, kendisi veya nesebinden birisinin bu işi yapmasından dolayı böyle denilmiş de olabileceği rivâyet edilmektedir. Fıkıh âlimlerinin, Eshâb-ı tercih diye tanınan tabakasından olduğu, şeyh-ül-İslâm Ahmed İbni Kemâl paşa hazretleri tarafından bildirilmiştir. 362 (m. 973)’de Bağdad’da doğdu. 428 (m. 1037) senesi Receb ayının beşinci Pazar günü orada vefât etti. Aynı gün, Ebû Half kapısı girişinde bulunan evinin yanına defnolundu. Daha sonra Mensûr caddesinde bulunan bir türbeye naklolundu. Burada medfûn bulunan, Hanefî fıkıh âlimlerinden Ebû Bekr el-Harezmî’nin ( radıyallahü anh ) yanına nakledildi.
Kudûrî ( radıyallahü anh ), Hanefî fıkıh âlimlerinin önde gelenlerindendir. İlminin çokluğu, ibâresinin güzelliği, akıcı lisânı ile fıkıh âlimleri arasındaki yeri ve derecesi çok yüksek oldu. Kur’ân-ı kerîmi tilâvet etmesi (okuması) çok hoş ve tatlı idi. Devamlı ibâdet eder ve Kur’ân-ı kerîmi çok okurdu. Ebû Abdullah Muhammed Yahyâ el-Cürcânî’den fıkıh ilmini öğrendi ve hadîs-i şerîf rivâyet etti. Bundan başka Ubeydullah bin Muhammed el-Havşebî ve birçok âlimler ile görüşüp sohbet etti. Kendilerinden ilim öğrendi. Âlimlerden bir çoğuna hocalık etti. Meşhûr Târih-i Bağdâd’ın sahibi olan Ebû Bekr Hatîb-i Bağdadî kendisinden ilim öğrenip, hadîs-i şerîf rivâyet edenler arasındadır. Târih-i Bağdâd’da diyor ki; “Kudûrî ( radıyallahü anh ) sadûk (çok doğru sözlü) ve sika, (güvenilir) bir zât idi.” Muhtasâr-ı Kudûrî’den başka kıymetli eserler de yazmıştır. Ba’zıları şunlardır: Şerh-i Muhtasâr-ül-Kerhî, et-Tecrid, Kitâb-ün-nikâh.
Kendisinden sonra gelen birçok kimseler Muhtasâr-ı Kudûrî diye tanınan meşhûr fıkıh kitabından istifâde etmişlerdir. Âlim olanlar ve olmayanlar, çok meşhûr ve mu’teber olan bu kitap ile teberrük etmişler; şiddet, sıkıntı, hastalık zamanlarında ve tâ’ûn (veba) salgınında okunmasının çok faydalı olacağını tecrübe ile bildirmişlerdir. Binlerce fıkhî mes’elenin kısa ve öz olarak toplanmış olduğu bu kitap, senelerce medreselerde ders kitabı olarak okutulmuştur. Birçok şerhi vardır. En meşhûrları; Cevhere, Lübâb ve Ebû Nasr-ı Akta’nın Tashîh-i Kudûrî’sidir.
Âlim, önder, en güzel üstünlüklere ve kıymete hâiz, Allahü teâlânın emirlerini yapmakta, yasaklarından sakınmakta son derece gayretli, dünyâya ehemmiyet ve kıymet vermiyen Ebü’l-Hasen Ahmed bin Muhammed el-Kudûrî el-Bâğdâdî (rahmetullahi aleyh) Muhtasâr-ı Kudûrî isimli eserine başlarken buyuruyor ki: “Âlemlerin Rabbi olan Allahü teâlâya hamdolsun. Hüsn-i hatime (Güzel netice, iyi akıbet) Allahü teâlâdan korkanlar içindir.
