UNDANG-UNDANG REPUBLIK INDONESIA
NOMOR 11 TAHUN 1980
TENTANG
TINDAK PIDANA SUAP

DENGAN RAHMAT TUHAN YANG MAHA ESA

Presiden Republik Indonesia,

Menimbang:

a. bahwa perbuatan suap dalam pelbagai bentuk dan sifatnya di luar yang diatur dalam peraturan perundang-undangan yang sudah ada pada hakekatnya juga bertentangan dengan kesusilaan dan moral Pancasila yang membahayakan kehidupan masyarakat dan bangsa;

b. bahwa perbuatan dimaksud pada sub a, belum ditetapkan sebagai perbuatan yang diancam dengan pidana, oleh karena itu perlu diatur dalam undang-undang tersendiri;

Mengingat:

1. Undang-undang Dasar 1945 Pasal 5 ayat (1) dan Pasal 20 ayat (1);

2. Katetapan Majelis Permusyawaratan Rakyat Nomor II/MPR/1978 tentang Pedoman Penghayatan dan Pengamalan Pancasila (Ekaprasetia Pancakarsa);

3. Undang-undang Nomor 1 Tahun 1946 tentang Peraturan Hukum Pidana jo. Undang-undang Nomor 73 Tahun 1958 tentang Menyatakan Berlakunya Undang-undang Nomor 1 Tahun 1946 Republik Indonesia tentang Peraturan Hukum Pidana untuk seluruh Wilayah Republik Indonesia dan mengubah Kitab Undang-undang Hukum Pidana (Lembaran Negara Tahun 1958 Nomor 127, Tambahan Lembaran Negara Nomor 1660), sebagaimana telah diubah dan ditambah terakhir dengan Undang-undang Nomor 4 Tahun 1976 (Lembaran Negara Tahun 1976 Nomor 26, Tambahan Lembaran Negara Nomor 3080);

Menetapkan : UNDANG-UNDANG TENTANG TINDAK PIDANA SUAP. LAW OF THE REPUBLIC OF INDONESIA

ABOUT
CRIME OF BRIBERY

BY THE GRACE OF GOD ALMIGHTY

President of the Republic of Indonesia,

Considering:

a. that the act of bribery in its various forms and beyond that stipulated in the legislation that already exists in essence is also contrary to morality and moral Pancasila which endanger the lives of the people and the nation;

b. that the act referred to in sub a, has not been established as a criminal act punishable with, therefore it needs to be regulated in a separate law;

Given:

1. Act of 1945, Article 5 (1) and Article 20 paragraph (1);

2. Katetapan People's Consultative Assembly No. II / MPR / 1978 on Implementation Guidelines Pancasila (Ekaprasetia Pancakarsa);

3. Law No. 1 of 1946 on the Criminal Code jo. Law No. 73 of 1958 concerning Declaration Applicability of Act No. 1 of 1946 of the Republic of Indonesia concerning Criminal Code for the entire territory of the Republic of Indonesia and change the Code of Criminal Law (Statute Book of 1958 No. 127, Supplement to Statute Book No. 1660) , as amended and supplemented the latest by Law No. 4 of 1976 (Statute Book of 1976 No. 26, Supplement to Statute Book No. 3080);
