Segurança e Protecção Civil

As presentes condições de utilização regulam a utilização da APLICAÇÃO SEGURANÇA E PROTEÇÃO CIVIL à frente designada por “App”, que é disponibilizada pela Associação Portuguesa de Técnicos de Segurança e Proteção Civil à frente designada por ASPROCIVIL. A App SEGURANÇA E PROTEÇÃO CIVIL é uma ferramenta útil para a segurança do cidadão e para a eficácia das ações operacionais. Contem uma série de ferramentas e informações relevantes e foi desenvolvida a pensar nas necessidades tanto dos cidadãos, como dos agentes da proteção civil. Os seus conteúdos incluem informação útil quer para uma emergência do cidadão comum, disponibilizando também, informações relevantes para os operacionais em caso de teatro de operações. Segurança e proteção civil tem como principal missão fornecer informações importantes acerca de medidas preventivas e de autoproteção a serem tomadas antes, durante e após uma emergência. O utilizador recebe ainda notificações sobre avisos e alertas de várias entidades sobre perigos/riscos identificados ou previstos.

CONCESSÃO DE DIREITOS
(1) A ASPROCIVIL concede ao utilizador o direito não exclusivo, simples, não transferível e não sublicenciável, para usar a App durante a duração do contrato e apenas para os fins do presente contrato. O utilizador pode transferir e usar a App exclusivamente para os aparelhos que estão associados ao ID do aparelho utilizado no download da APP.(2) A reprodução da App só é permitida ao utilizador na medida em que seja necessária para a utilização da App nos termos do contrato. O utilizador não pode conferir  a terceiros o acesso à App, alugá-la nem cedê-la temporariamente. Todos os direitos não concedidos explicitamente no presente contrato consideram-se como não tendo sido conferidos ao utilizador. (3) Os conteúdos incluídos na App são na  maioria dos casos protegidos por direitos de autor. Assim, estes conteúdos apenas podem ser usados pelo utilizador para fins pessoais e não comerciais. Qualquer uso comercial destes conteúdos exige o consentimento prévio da ASPROCIVIL.(4) A utilização, reprodução ou transmissão não autorizada dos conteúdos da App, fora do contexto antes referido, não é autorizada e pode acarretar consequências legais.

EXCLUSÃO DA RESPONSABILIDADE
(1) Se o utilizador reclamar uma indemnização por danos ou o reembolso de despesas devido a uma falha ou por outros motivos, a ASPROCIVIL só é responsável, nos termos das disposições legais nos casos de dolo e culpa grave.(2) Na medida em que ASPROCIVIL, detentora dos direitos desta App, recolhe, recebe e reúne informação por outras entidades disponibilizada e atualizada, a ASPROCIVIL não se RESPONSABILIZA E DECLINA QUALQUER IMPUTAÇÃO DE CUSTOS OU PREJUIZOS, seja em que modo ou circunstância, eles aconteçam, incluindo prejuízos de qualquer índole que ocorram em resultado de falta de exatidão ou omissão ou ainda incorreção das informações prestadas, no âmbito do funcionamento desta app.(3) Os conteúdos configurados pela própria ASPROCIVIL na App são criados/identificados e produzidos com o máximo rigor e cuidado. Apesar disso, e atendendo à realidade de exposição pública e de utilização (má ou negligente), de falta de manutenção, da alteração de localizações, o não funcionamento (total ou parcial) e/ou inexistência dos elementos geolocalizados, (e/ou indicados na App) fica desde já declarado e aceite que a ASPROCIVIL não garante a exatidão, a integridade e a atualidade das informações/conteúdos disponibilizados nesta App.

DISPOSIÇÕES FINAIS
(1) Em matéria de interpretação das presentes condições de utilização é aplicável o direito Português.(2) Quaisquer litígios resultantes deste contrato, estão sujeitos à jurisdição dos tribunais regulares Portugal onde se localiza a sede da ASPROCIVIL, ficando desde já definida a comarca de Lisboa para este efeito.(3) Se uma disposição das presentes condições de utilização for ou se tornar total ou parcialmente inválida, a validade das restantes disposições não é afetada por isso. The present conditions of use govern your use of the APPLICATION SECURITY AND CIVIL PROTECTION ahead called "App", which is made available by the Portuguese Association of Technical Security and Civil Protection called ahead ASPROCIVIL. The App SECURITY AND CIVIL PROTECTION is a useful tool for citizen security and the efficiency of operational activities. It contains a number of tools and relevant information and was developed for the needs of both citizens, as the civil protection agents. Its contents include useful information either to an emergency of ordinary citizens, providing also relevant information for operating in case of theater. Security and civil protection's main mission is to provide important information about preventive measures and self-protection to be taken before, during and after an emergency. The user also receives notifications of warnings and alerts of various entities on hazards / risks identified or expected.

GRANT OF RIGHTS
(1) The ASPROCIVIL grants you the non-exclusive, simple, non-transferable and non-sublicensable, to use the app during the contract period and only for the purposes of this contract. You can download and use the app exclusively for devices that are associated with the device ID used to download the APP. (2) The reproduction of the App is only allowed users to the extent that is necessary for the use of the App under the contract. You may not give third parties access to the App, rent it or give it up temporarily. All rights not expressly granted in this contract are considered as not having been granted to the user. (3) The contents included in App are in most cases protected by copyright. Thus, these contents can only be used by the user for personal and non-commercial. Any commercial use of such content requires the prior consent of ASPROCIVIL. (4) The use, reproduction or transmission of unauthorized App content, out of context referred to above, is not permitted and can lead to legal consequences.

Disclaimers
(1) If the user claim compensation for damages or reimbursement of expenses due to failure or other reasons, the ASPROCIVIL is only liable under the statutory provisions in cases of willful misconduct and gross negligence. (2) To the extent that ASPROCIVIL, holder of the rights of this App, collects, receives and compiles information available and updated by other entities, the ASPROCIVIL not LIABILITY AND ATTRIBUTION DISCLAIMS ANY COSTS OR DAMAGES, in whatever manner or circumstance, they happen, including losses of any nature occurring as a result of inaccuracy or omission or inaccuracy of the information provided under the operation of this app. (3) The contents set by the very ASPROCIVIL the App are created / identified and produced with the utmost rigor and care. Nevertheless, and given the reality of public exposure and use (bad or negligent), lack of maintenance, changing locations, the non-operating (total or partial) and / or lack of geo-elements (and / or indicated in App) is hereby declared and accepted that ASPROCIVIL not guarantee the accuracy, integrity and timeliness of the information / content provided in this App.

FINAL PROVISIONS
(1) In the interpretation of these terms of use shall apply Portuguese law. (2) Any dispute arising from this contract are subject to the jurisdiction of regular courts Portugal where the seat of the ASPROCIVIL, it being defined the county Lisbon for this purpose. (3) If a provision of these conditions of use is or becomes wholly or partially invalid, the validity of the remaining provisions is not affected by this.
