Partie I : Les sources et les garanties d’application du droit social
I Les sources internationales
1° Les conventions de l’Organisation Internationale du Travail (OIT) L’OIT a son siège à Genève et son bureau à Rome. C’est une sorte d’agence similaire à l’ONU pour les questions sociales. Elle travaille par des assemblées générales sur des questions planétaires ou sur un pays précis. Les délégations de chaque pays comprennent 3 composantes :
- une délégation gouvernementale composée de hauts fonctionnaires
- représentants des organisations de salariés
- représentants des organisations d’employeurs
Le système a très peu fonctionné dans les dictatures communistes de l’après-guerre et fonctionne surtout pour les démocraties libérales. Dans le cadre de l’OIT, il se négocie des conventions :
1- discussion, élaboration
2- signature par l’exécutif de chaque Etat
3- ratification : le pouvoir législatif approuve ce que l’exécutif a signé
4- application
Mais, ces conventions peuvent poser des problèmes :
- l’OIT regroupe des pays extrêmement divers (économiquement et culturellement)
- certains Etats signent une convention mais ne sont pas obligés de la ratifier
- le danger est que seulement certains Etats appliquent une convention et donc subissent seuls les coûts sociaux élevés. Ils peuvent mettre une clause stipulant un nombre minimum de pays appliquent la convention avant de l’appliquer. Part I: The sources and application guarantees of social law
I International sources
1. The conventions of the International Labor Organization (ILO) The ILO headquarters in Geneva and its office in Rome. It's kind of like the UN agency for social issues. It works by general meetings on global issues or a specific country. Delegations from each country include three components:
- a government delegation consisting of senior officials
- representatives of employee organizations
- representatives of employers' organizations
The system has very few worked in communist dictatorships in post-war and especially works for liberal democracies. In the framework of the ILO, it is negotiating an agreement:
1- discussion development
2- signed by the executive of each state
3- ratification: the legislature approves that the executive signed
4- Application
But these agreements may cause problems:
- ILO brings together extremely diverse country (economically and culturally)
- some States sign an agreement but are not obliged to ratify
- the danger is that only some states apply a convention and therefore suffer only the high social costs. They can put a clause stipulating a minimum number of countries apply the agreement before applying.
