Promulguant la Constitution adoptée par le Conseil National de Transition le
19 avril 2010
LE PRESIDENT DE LA TRANSITION, PRESIDENT DE LA REPUBLIQUE PAR
INTERIM
Vu le Communiqué n°001/CNDD/2008 du 23 décembre 2008, portant prise effective du
pouvoir par le Conseil National pour la Démocratie et le Développement (CNDD),
Suspension de la Constitution et dissolution du Gouvernement ;
Vu l’Ordonnance n°006/PRG/CNDD/2008 du 29 Décembre 2008, portant création d’un
poste de Premier Ministre ;Vu l’Ordonnance n°001/PRG/CNDD/SGPRG/2010 du 09
février 2010, portant création du Conseil National de la Transition (CNT) ;
Vu l’Ordonnance n°006/PRG/CNDD/SGPRG/2010 du 05 mai 2010, portant attributions
et composition du Conseil National de la Transition (CNT) ;
Vu le Procès Verbal de la Réunion du CNDD en date du 06 janvier 2010 désignant
Monsieur le Ministre de la Défense Nationale, 2ème Vice- Président du CNDD comme
Président de la République par intérim ;
Vu les Accords de Ouagadougou en date du 15 janvier 2010, désignant Monsieur le
Ministre de la Défense Nationale, 2ème Vice- Président du CNDD comme Président de la
République par intérim, Président de la Transition ;Vu le Décret
n°001/PRG/CNDD/SGPRG/2010 du 19 janvier 2010, portant nomination du Premier
Ministre, Chef du Gouvernement d’Union Nationale de la Transition ;
Vu le Décret n°003/PRG/CNDD/SGPRG/2010 du 03 Février 2010, portant
restructuration du Gouvernement ;
Vu le Décret n°004/PRG/CNDD/SGPRG/2010 du 09 Février 2010, portant nomination

de la Présidente et des Deux Vice- Présidents du Conseil National de Transition (CNT) ;
Vu le Décret n°014/PRG/CNDD/SGPRG/2010 du 07 Mars 2010, portant nomination des
membres statutaires du Conseil National de Transition (CNT) ;
Vu la lettre de mission du Conseil National de Transition, en date du 18 Février 2010 ;
DECRETE :
Article 1er : La Constitution adoptée par le Conseil National de Transition le 19 avril 2010
est promulguée dans la teneur qui suit :
Préambule
Par son vote du 28 septembre 1958, le Peuple de Guinée a opté pour la liberté et constitué,
le 2 octobre 1958, un Etat souverain:
LA REPUBLIQUE DE GUINEE;
Tirant les leçons de son passé et des changements politiques intervenus depuis lors ;
LE PEUPLE DE GUINEE
Proclame :
- Son adhésion aux idéaux et principes, droits et devoirs établis dans la Charte de
l'Organisation des Nations Unies, la Déclaration Universelle des Droits de l'Homme, les
Conventions et Pactes internationaux relatifs aux droits de l’Homme, l’Acte constitutif de
l’Union Africaine, la Charte Africaine des Droits de l'Homme et des Peuples et ses
protocoles additionnels relatifs aux droits de la femme, ainsi que le Traité révisé de la
CEDEAO et ses protocoles sur la démocratie et la bonne gouvernance.
Réaffirme :
- Sa volonté d’édifier dans l'unité et la cohésion nationale, un Etat de Droit et de
Démocratie pluraliste.
-Sa volonté de promouvoir la bonne gouvernance et de lutter résolument contre la

corruption et les crimes économiques. Ces crimes sont imprescriptibles.
- Sa volonté d'établir des relations d'amitié et de coopération avec tous les peuples du
monde sur la base des principes de l'égalité, du respect de la souveraineté nationale, de
l'intégrité territoriale et de l'intérêt réciproque;
- Son attachement à la cause de l'unité africaine, de l'intégration sous-régionale et régionale
du continent.
Libre de déterminer ses Institutions, le Peuple de Guinée adopte la présente Constitution. PRESIDENCY OF THE REPUBUQUE

Promulgating the Constitution adopted by the National Transitional Council
April 19, 2010
THE PRESIDENT OF THE TRANSITION PRESIDENT OF THE REPUBLIC BY
INTERIM
Given Communiqué No. 001 / CNDD / 2008 of 23 December 2008, bringing the actual decision
power by the National Council for Democracy and Development (CNDD)
Suspension of the Constitution and dissolution of the Government;
Considering Ordinance No. 006 / PRG / CNDD / 2008 of 29 December 2008, establishing a
Prime Minister, Considering Ordinance No. 001 / PRG / CNDD / SGPRG / 2010 of 09
February 2010 on the establishment of the National Transitional Council (NTC);
Considering Ordinance No. 006 / PRG / CNDD / SGPRG / 2010 05 May 2010, on the responsibilities
and composition of the National Transition Council (CNT);
Given the Verbal Trial of the CNDD Meeting dated January 6, 2010 designating
The Minister of National Defense, 2nd Vice President of the CNDD as
President of the Republic Acting;
Considering the Ouagadougou Agreements dated 15 January 2010, appointing Mr.
Minister of National Defense, 2nd Vice President of the CNDD as President
Republic Acting President of the Transition; Pursuant to Decree
001 / PRG / CNDD / SGPRG / 2010 of 19 January 2010 appointing the Prime
Minister, Head of Government of National Union of Transition;
Pursuant to Decree No. 003 / PRG / CNDD / SGPRG / 2010 of 3 February 2010, bringing
restructuring of the Government;
Pursuant to Decree No. 004 / PRG / CNDD / SGPRG / 2010 of 09 February 2010 appointing

of the President and two Vice-Presidents of the National Transitional Council (NTC);
Pursuant to Decree No. 014 / PRG / CNDD / SGPRG / 2010 of 7 March 2010 appointing the
statutory members of the National Transitional Council (NTC);
Given the mission statement of the National Transitional Council, dated 18 February 2010;
DECREES:
Article 1: The Constitution adopted by the National Transitional Council April 19, 2010
is promulgated in the following content:
Preamble
By its vote of 28 September 1958, the People of Guinea opted for freedom and constituted
October 2, 1958, a sovereign state:
The Republic of Guinea;
Drawing lessons from the past and the political changes since then;
THE PEOPLE OF GUINEA
proclaim:
- Its membership to the ideals and principles, rights and duties established in the Charter of
the United Nations, the Universal Declaration of Human Rights,
International Conventions and Covenants on Human Rights, the Constitution
the African Union, the African Charter on Human and Peoples' Rights and its
additional protocols relating to women's rights and the Revised Treaty of
ECOWAS and its protocols on democracy and good governance.
reaffirms:
- His desire to build in unity and national cohesion, a State of Law and
pluralist democracy.
-Its commitment to promote good governance and fight resolutely against

corruption and economic crimes. These crimes are imprescriptible.
- His will to establish relations of friendship and cooperation with all peoples of
world based on the principles of equality, respect for national sovereignty,
territorial integrity and mutual interest;
- His commitment to the cause of African unity, integration, subregional and regional
from the continent.
Free to determine its Institutions, the People of Guinea adopted this Constitution.
