L'infraction est une action ou une omission qui se manifeste comme une atteinte à l'ordre social et que la loi sanctionne par une peine. Nulle infraction ne peut être punie des peines qui n'étaient pas prononcées par la loi, avant qu'elle fût commise.
Toutefois, dans le concours de deux lois pénales, l'une ancienne sous l'empire de laquelle l'infraction a été commise et l'autre promulguée depuis l'infraction et avant qu'un jugement définitif ait été rendu, la loi nouvelle doit seule être appliquée si elle édicte une peine moins sévère.
Sauf dispositions contraires, le livre premier du présent code est applicable aux infractions prévues par les lois et règlements particuliers. Toutefois cette application ne se fera pas lorsqu'elle aurait pour effet de réduire les peines pécuniaires établies pour assurer la perception des droits fiscaux ou la réparation civile du préjudice causé à l'Etat ou à une autre personne morale de droit public. Article: 1
The offense is an act or omission that is manifested as an attack on the social order and the law punishes by a penalty. No offense may be punished with the penalties that were not imposed by law before it was committed.
However, in the contest of two criminal laws, the former under the influence of which the offense was committed and the other passed since the offense and before a final judgment was rendered, the new law should only be applied if it enacts a lesser sentence.
Unless otherwise specified, the first book of this Code is applicable to offenses under the special laws and regulations. However this application will not be made if it would reduce the financial penalties established to ensure the collection of tax rights or civil compensation for damage caused to the State or to another legal person of public law.
