بداية المجتهد هو كتاب فقهي يحتوي على الفقه المقارن وقد ألفه الفيلسوف المالكي ابن رشد الحفيد، ويُعتبر من أفضل الكتب التي اشتملت على بيان أسباب الاختلاف بين العلماء في كل مسألة
قال ابن رشد في مقدمة الكتاب
بداية المجتهد ونهاية المقتصد فإن غرضي في هذا الكتاب أن أثبت فيه لنفسي على جهة التذكرة من مسائل الأحكام المتفق عليها والمختلف فيها بأدلتها، والتنبيه على نكت الخلاف فيها ما يجري مجرى الأصول والقواعد لما عسى أن يرد على المسائل المنطوق بها في الشرع أو تتعلق بالمنطوق به تعلقا قريبا، وهي المسائل التي وقع الاتفاق عليها أو اشتهر الخلاف فيها بين الفقهاء الإسلاميين من لدن الصحابة رضي الله عنهم إلى أن فشا التقليد
أما بعد حمد الله بجميع محامده، والصلاة والسلام على محمد رسوله وآله وأصحابه،
فإن غرضي في هذا الكتاب أن أثبت فيه لنفسي (في نسخة فاس: التنبيه لنفسي بدل أن أثبت) (انظر ترجمة المؤلف آخر الكتاب)
على جهة التذكرة من مسائل الأحكام المتفق عليها والمختلف فيها بأدلتها، والتنبيه على نكت الخلاف فيها، ما يجري مجرى الأصول والقواعد لما عسى أن يرد على المجتهد من المسائل المسكوت عنها في الشرع، وهذه المسائل في الأكثر هي المسائل المنطوق بها في الشرع أو تتعلق بالمنطوق به تعلقا قريبا، وهي المسائل التي وقع الاتفاق عليها، أو اشتهر الخلاف فيها بين الفقهاء الإسلاميين من لدن الصحابة رضي الله عنهم إلى أن فشا التقليد.
وقبل ذلك فلنذكر كم أصناف الطرق التي تتلقي منها الأحكام الشرعية، وكم أصناف الأحكام الشرعية، وكم أصناف الأسباب التي أوجبت الاختلاف بأوجز ما يمكننا في ذلك. فنقول:
إن الطرق التي منها تلقيت الأحكام عن النبي عليه الصلاة والسلام بالجنس ثلاثة: إما لفظ، وإما فعل، وإما إقرار. وأما ما سكت عنه الشارع من الأحكام فقال الجمهور: إن طريق الوقوف عليه هو القياس. وقال أهل الظاهر: القياس في الشرع باطل، وما سكت عنه الشارع فلا حكم له. ودليل العقل يشهد ثبوته [أي ثبوت القياس. دار الحديث]، وذلك أن الوقائع بين أشخاص الأناسي غير متناهية، والنصوص والأفعال والإقرارات متناهية، ومحال أن يقابل ما لا يتناهى بما يتناهى.
وأصناف الألفاظ التي تتلقى منها الأحكام من السمع أربعة: ثلاثة متفق عليها، ورابع مختلف فيه. أما الثلاثة المتفق عليها فلفظ عام يحمل على عمومه، أو خاص يحمل على خصوصه، أو لفظ عام يراد به الخصوص، أو لفظ خاص يراد به العموم، وفي هذا يدخل التنبيه بالأعلى على الأدنى، وبالأدنى على الأعلى، وبالمساوي على المساوى .
