ingredient labels on food products - witness 300K emergency room visits a year. The Allergy App quickly determines whether a food product is safe to consume by scanning the product’s UPC barcode and provides audio/visual alerts, taking confusion and stress out of shopping. This app is provided for educational purposes only and is not intended for medical advice, diagnosis or treatment. It is not HIPAA-compliant and contains no PII. THE CLIENT SOFTWARE (AS DEFINED BELOW) YOU DOWNLOADED HAS BEEN PROVIDED BY Digiminds. BY INSTALLING OR USING ALL OR ANY PORTION OF THE CLIENT SOFTWARE, YOU ACCEPT ALL TERMS AND CONDITIONS OF THIS END USER LICENSE AGREEMENT (the "EULA") and the Terms of Use available at http://allergyapp.weebly.com; collectively referred to herein as the "Agreement").

The "Client Software" consists of: (a) The Allergy App client software program and any files that are delivered to you by Digiminds (via online transmission or otherwise) (collectively, the "Program"); and (b) the services provided by the Client Software. The Client Software is the copyrighted work of Digiminds and may contain trademarks, service marks, trade names, and other intellectual property of Digiminds.

Digiminds and you hereby agree as follows:

1. Grant of Limited Use License.
Digiminds hereby grants, and you hereby accept, a limited, non-exclusive license to: (a) install the Client Software on up to 3 Android smartphones or computers, all of which must be owned by you or under your legitimate control; and (b) engage in non-commercial use of the Client Software.

The license granted above is subject to the limitations set forth below. You will not:
A. in whole or in part, copy, reproduce, translate, modify, adapt, create derivative works based on, or reverse engineer, derive source code from, disassemble, decompile, or otherwise attempt to discover the source code of, the Client Software, but you may make one copy of Client Software for archival purposes only;

B. remove, obscure, or alter any copyright, trademark, logo or notice in or on the Client Software;

C. Mine, intercept, emulate, or redirect the communication protocols or data used by Client Software in any way or engage in interfering with or disrupting Client Software

2. Ownership.
You acknowledge and agree that Digiminds has all rights and title to the Client Software, including any intellectual property rights therein. The structure and code of the Client Software are trade secrets and confidential information of Digiminds. The Client Software is protected by the copyright laws of the United States, international treaties and conventions.

3. Use of the Client Software.
The Client Software may allow you to access/interoperate with third party software and data services (collectively, "3rd Party Sites"). Digiminds has no control over any 3rd Party Sites. You acknowledge and agree that Digiminds is not liable for any loss or damage which may be incurred by you as a result of the availability of those 3rd Party Sites, or as a result of any reliance placed by you on the completeness, accuracy, or existence of any materials on or available from 3rd Party Sites.

4. Warranty Disclaimer
THE CLIENT SOFTWARE IS DELIVERED TO YOU "AS IS" AND WITH ALL FAULTS. DIGIMINDS MAKES NO WARRANTIES, CONDITIONS, REPRESENTATIONS, OR TERMS, EXPRESS OR IMPLIED. YOU ARE SOLELY RESPONSIBLE FOR ANY DAMAGE TO YOUR COMPUTER, PHONE OR OTHER DEVICE.

5. Limitation of Liability
IN NO EVENT WILL DIGIMINDS BE LIABLE TO YOU FOR ANY DAMAGES, CLAIMS, OR COSTS WHATSOEVER, INCLUDING WITHOUT LIMITATION ANY CONSEQUENTIAL, INDIRECT, OR INCIDENTAL DAMAGES.
